Members of the Madison County Sheriff’s Office Criminal Investigations Division and Computer Crimes Unit arrested Mason L. Berry, age 39 of Glass Factory Road in the Madison County Town of Smithfield as a result of a criminal investigation.
Berry has been charged with one count of possessing a sexual performance by a child (Class E Felony) and one count of promoting a sexual performance by a child (Class D Felony). It is alleged that Berry possessed digital images of a child engaged in a lewd exhibition and also promoted a sexual performance of a child by distributing the digital files.
Berry was arraigned in Smithfield Town Court and was remanded to the Madison County Jail in lieu of $10,000 cash bail or $20,000 bail bond; he has since posted bond. Berry is scheduled to reappear at court again Nov. 14, 2016.
