Darryl Boscoe Allegedly Pushed Resident Down Hallway, Causing A Fall And Rib Fracture

Schneiderman: Medical Professionals Who Jeopardize Safety of Patients Will Be Held Accountable

Attorney General Eric T. Schneiderman today announced that Darryl Boscoe, 61, a Licensed Practical Nurse, was arraigned in Oswego City Court, in Oswego County, on the charge ofEndangering the Welfare of a Vulnerable Elderly Person or an Incompetent or Physically Disabled Person in the Second Degree. The defendant entered a not guilty plea. The Court issued an Order of Protection in this case.

“Nurses are entrusted with the care of our most vulnerable citizens, and they must treat them with the care and respect they deserve,” Attorney General Schneiderman said. “Today’s arrest sends the message that medical professionals who disregard their training and jeopardize the safety of their patients will be held accountable.”

These charges arose out of an incident on November 8, 2016, involving Boscoe and an 89-year-old male resident of Pontiac Care and Rehabilitation Center in Oswego. It is alleged that Boscoe recklessly caused physical injury to the resident when he resorted to the use of physical force with the resident, by pushing the resident down a hallway, during which the resident fell and suffered a nondisplaced fracture to his left lateral seventh rib.

Boscoe resides in Oswego, New York. He has worked at Pontiac Care and Rehabilitation Center for approximately two years.

The endangering charge is punishable by up to seven years in prison.

The charge against Boscoe is merely an accusation, and the defendant is presumed innocent unless and until proven guilty in a court of law.

This case was investigated by Investigator Keith Hall, under the supervision of Christopher Burns, Supervising Investigator of the Syracuse Regional Office of the Attorney General’s Medicaid Fraud Control Unit.

The case is being prosecuted by Special Assistant Attorney General Irene Bardot, under the supervision of Ralph D. Tortora, III, Regional Director, Syracuse Regional Office of the Attorney General’s Medicaid Fraud Control Unit. William Falk is the Deputy Chief Investigator-Upstate. Catherine Wagner is Chief of Criminal Investigations-Upstate. The Medicaid Fraud Control Unit is led by Director Amy Held and Assistant Deputy Attorney General Paul J. Mahoney. The Division of Criminal Justice is led by Chief Deputy Attorney General Jason Brown.
