On July 9, 2017, at approximately 8:09 PM, Trooper Joel R. Davis was dispatched to a domestic with shots being fired at 34371 County Route 46, town of Theresa.

At approximately 8:30 PM, Trooper Davis arrives and parks his patrol vehicle on the roadway approximately 75 feet prior to reaching the driveway to the residence.

Trooper Davis radios that there are shots being fired.

Trooper Davis exits his vehicle and walks towards the driveway, when he is shot once.

Within minutes, another Trooper arrives at the scene and is unable to locate Trooper Davis.

The Trooper hears gunfire and returns to his vehicle and observes the suspect, Justin Walters, standing in the driveway.

The Trooper exits the vehicle, drawing his service weapon at Walters.

The Trooper then sees Trooper Davis laying in a ditch on the side of the roadway.

Additional Troopers arrive, attending to Trooper Davis and taking Walters into custody.

A second victim, Nichole V. Walters, the wife of Justin Walters, was found deceased in the driveway of the residence with multiple gunshot wounds.

A third victim, Rebecca A. Finkle, was shot in her upper torso.  Her injuries are non-life threatening.

Trooper Davis was taken to Samaritan Medical Center in Watertown, NY where he succumbed to his injuries at 9:23 PM.

Justin Walters was arraigned on one count of Murder 1st degree and one count Murder 2nddegree in the Town of Leray Court and he will be re-arraigned at 5:00 pm on July 10.

Trooper Davis was a four year veteran of the New York State Police, first assigned here to SP Watertown when he graduated the Academy, and most recently assigned to SP Philadelphia.

Trooper Davis, 36, is survived by his wife and three children.
