Madison County Sheriff’s Office investigators arrested Marion Hoch-Schmidtka, 27, of 238 West Elm St., Oneida, and charged her with third-degree welfare fraud and third-degree grand larceny (both class D felonies), first-degree offering a false instrument for filing (class E felony) and third-degree perjury (class A misdemeanor).

It is alleged that Schmidtka, who was collecting public assistance, intentionally provided false documentation to the Madison County Department of Social Services. This documentation failed to show that her children’s father was residing in her residence and he was also earning an income from employment. Because of this fraudulent act, Schmidtka obtained $3,854 in public assistance that she would not have received if she had reported the income.

She was arraigned in Lenox Town Court and released on her own recognizance. She is scheduled to return to Lenox Town Court at a later date to answer the charges.
