Attorney General Letitia James has taken action against\nDitech Holding Corporation by filing a brief in the U.S. Bankruptcy Court for\nthe Southern District of New York, opposing the mortgage servicer\u2019s attempted\nend-run around statutory protections for homeowners.<\/p>\n\n\n\n

\u201cBankruptcy court should never be used as a tool to unjustly\noust New Yorkers from their homes,\u201d said James. \u201cDitech\u2019s action is an illegal\nattempt to strip hundreds of homeowners of their legitimate claims and\neviscerate New York\u2019s carefully created foreclosure process. Housing is a\nright, and we will continue to use every legal tool at our disposal to stand up\nfor homeowners and to protect their rights.\u201d<\/p>\n\n\n\n

Ditech has more than 880 active foreclosure actions pending\nacross New York state. Homeowners organized the Consumer Creditors Committee to\nensure that the courts do not permit the company to sweep their rights under\nthe rug. Homeowners are demanding that their claims and defenses \u2014 which\ninclude significant money damages \u2014 not be extinguished in bankruptcy court.<\/p>\n\n\n\n

James \u2014 in support of the Consumer Creditors\u2019 Committee \u2014 is\nfiling the objection to ensure that vulnerable homeowners, who were victims of\npredatory lending and mortgage servicing abuses, including seniors with reverse\nmortgages, can assert their rights under the protections of New York\u2019s robust\njudicial foreclosure process. <\/p>\n\n\n\n

In addition to filing this motion, the Office of the New\nYork State Attorney General currently has an open investigation into Reverse\nMortgage Solutions, a reverse mortgage servicer that is owned by Ditech.<\/p>\n\n\n\n

This past March, James took a similar action when a building\nowner in Manhattan attempted to flout rent regulation laws and displace\ntenants.<\/p>\n\n\n\n

The objection is being handled by Assistant Attorneys\nGeneral Elena Gonz\u00e1lez, Elizabeth M. Lynch, and Sarah Trombley of the Bureau of\nConsumer Frauds and Protection, under the supervision of Bureau Chief Jane M.\nAzia, as well as Enid Nagler Stuart, Special Bankruptcy Counsel for the\nLitigation Bureau. The Bureau of Consumer Frauds and Protection is overseen by\nChief Deputy Attorney General for Economic Justice Christopher D\u2019Angelo, and\nthe Litigation Bureau is overseen by Chief Deputy Attorney for State Counsel\nOrelia Merchant.<\/p>\n","protected":false},"excerpt":{"rendered":"
