{"id":119931,"date":"2021-12-14T11:33:21","date_gmt":"2021-12-14T16:33:21","guid":{"rendered":"https:\/\/madisoncountycourier.com\/?p=119931"},"modified":"2021-12-14T11:33:21","modified_gmt":"2021-12-14T16:33:21","slug":"attorney-general-continues-to-fight-nras-efforts-to-dismiss-corruption-lawsuit","status":"publish","type":"post","link":"https:\/\/madisoncountycourier.com\/?p=119931","title":{"rendered":"Attorney General continues to fight NRA\u2019s efforts to dismiss corruption lawsuit"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">New York Attorney General Letitia James released the following statement after oral arguments concluded over a second round of motions brought forward by the National Rifle Association, Executive Vice-President Wayne LaPierre and Corporate Secretary and General Counsel John Frazer as they sought to dismiss a lawsuit filed by James against the organization last summer:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>\u201cThe NRA is fraught with fraud, abuse, and illegality that has permeated the organization \u2014 this is why we filed our lawsuit to remove senior leadership and dissolve the organization last year. For more than a year now, the NRA has utilized one tactic after another to delay accountability, but each time the courts have rejected these maneuvers. This latest, and second, effort to dismiss our lawsuit is a blatant attempt to avoid transparency and accountability, and we are hopeful that the court will reject it like the last one. The NRA does not get to dictate if and where they will answer for their actions. No one is above the law, not even one of the most powerful organizations in the country.\u201d<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Last August, <a href=\"https:\/\/lnks.gd\/l\/eyJhbGciOiJIUzI1NiJ9.eyJidWxsZXRpbl9saW5rX2lkIjoxMDAsInVyaSI6ImJwMjpjbGljayIsImJ1bGxldGluX2lkIjoiMjAyMTEyMTAuNTAxMTg1MzEiLCJ1cmwiOiJodHRwczovL2FnLm55Lmdvdi9wcmVzcy1yZWxlYXNlLzIwMjAvYXR0b3JuZXktZ2VuZXJhbC1qYW1lcy1maWxlcy1sYXdzdWl0LWRpc3NvbHZlLW5yYSJ9.s4e2QtxQUaFLeJHjQxVvJTA0ghHWTVBwTA3NmxiT5E4\/s\/1807814627\/br\/122807595363-l\" target=\"_blank\" rel=\"noreferrer noopener\">James filed a lawsuit against the NRA and four of the organization\u2019s current or former top executives for failing to manage the NRA\u2019s funds; failing to follow numerous state and federal laws, as well as the NRA\u2019s own bylaws and policies; and contributing to the loss of more than $64 million in just three years<\/a>. The suit was filed against the NRA as a whole, as well as LaPierre, Frazer, former Treasurer and Chief Financial Officer Wilson \u201cWoody\u201d Phillips and former Chief of Staff and Executive Director of General Operations Joshua Powell.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The NRA then moved to dismiss James\u2019 complaint in its entirety, stay the action and change the venue to an Albany court. This past January, <a href=\"https:\/\/lnks.gd\/l\/eyJhbGciOiJIUzI1NiJ9.eyJidWxsZXRpbl9saW5rX2lkIjoxMDEsInVyaSI6ImJwMjpjbGljayIsImJ1bGxldGluX2lkIjoiMjAyMTEyMTAuNTAxMTg1MzEiLCJ1cmwiOiJodHRwczovL2FnLm55Lmdvdi9wcmVzcy1yZWxlYXNlLzIwMjEvY291cnQtb3JkZXJzLWF0dG9ybmV5LWdlbmVyYWwtamFtZXMtbGF3c3VpdC1hZ2FpbnN0LW5yYS1jb250aW51ZS1tYW5oYXR0YW4tY291cnQifQ._dLUlG_8BFyMDXjfe41rFbbki7JVXolPe84lvs5GpxQ\/s\/1807814627\/br\/122807595363-l\" target=\"_blank\" rel=\"noreferrer noopener\">the New York County State Supreme Court ruled that the case be permitted to continue in a Manhattan court, and not be moved to an Albany court or dismissed outright<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Days before that ruling, in an effort to avoid accountability altogether, <a href=\"https:\/\/lnks.gd\/l\/eyJhbGciOiJIUzI1NiJ9.eyJidWxsZXRpbl9saW5rX2lkIjoxMDIsInVyaSI6ImJwMjpjbGljayIsImJ1bGxldGluX2lkIjoiMjAyMTEyMTAuNTAxMTg1MzEiLCJ1cmwiOiJodHRwczovL2FnLm55Lmdvdi9wcmVzcy1yZWxlYXNlLzIwMjEvbnJhcy1maW5hbmNpYWwtc3RhdHVzLWZpbmFsbHktbWF0Y2hlcy1tb3JhbC1zdGF0dXMtYmFua3J1cHQifQ.edV-dd0g6frjcnGLlKi7hRccOoNdDjE5f4ycFf6B9pU\/s\/1807814627\/br\/122807595363-l\" target=\"_blank\" rel=\"noreferrer noopener\">the NRA filed for chapter 11 bankruptcy<\/a>, even though the organization still claimed to have healthy financial reserves. Over the course of the bankruptcy trial, LaPierre and other senior leaders admitted that the bankruptcy was simply a way of avoiding New York\u2019s enforcement action, yet still stated that they believed that New York courts and judges could be trusted to fairly and impartially oversee the case.
