{"id":74660,"date":"2016-10-29T15:43:31","date_gmt":"2016-10-29T19:43:31","guid":{"rendered":"http:\/\/madisoncountycourier.com\/?p=74660"},"modified":"2016-10-29T17:51:12","modified_gmt":"2016-10-29T21:51:12","slug":"felony-leandras-law-dwi-charged-in-verona","status":"publish","type":"post","link":"https:\/\/madisoncountycourier.com\/?p=74660","title":{"rendered":"Felony Leandra&#8217;s Law DWI charged in Verona"},"content":{"rendered":"<p><a href=\"http:\/\/madisoncountycourier.com\/?attachment_id=74664\" rel=\"attachment wp-att-74664\"><img loading=\"lazy\" decoding=\"async\" class=\"alignright size-thumbnail wp-image-74664\" src=\"http:\/\/madisoncountycourier.com\/wp-content\/uploads\/2016\/10\/Moriarty-James-114x150.jpg\" alt=\"moriarty-james\" width=\"114\" height=\"150\" srcset=\"https:\/\/madisoncountycourier.com\/wp-content\/uploads\/2016\/10\/Moriarty-James-114x150.jpg 114w, https:\/\/madisoncountycourier.com\/wp-content\/uploads\/2016\/10\/Moriarty-James-228x300.jpg 228w, https:\/\/madisoncountycourier.com\/wp-content\/uploads\/2016\/10\/Moriarty-James-400x526.jpg 400w, https:\/\/madisoncountycourier.com\/wp-content\/uploads\/2016\/10\/Moriarty-James.jpg 429w\" sizes=\"auto, (max-width: 114px) 100vw, 114px\" \/><\/a>Oneida-based state police charged a Rome man with felony DWI under Leandra&#8217;s Law following an arrest in the town of Verona Friday evening.<\/p>\n<p>At approximately 6:20 p.m. Oct. 28, 2016, Troopers Terry Horton and Richard Kosakowski were dispatched by Oneida County 911 to the Dunkin Donuts on Willow Place in Verona to check the status of a patron who appeared to be highly intoxicated driving with a child in his vehicle.<\/p>\n<p>Upon arrival, witnesses directed the troopers\u00a0toward a 2002 Honda Odyssey parked in front of the store with a man\u00a0sitting in\u00a0the driver&#8217;s seat. Troopers were advised the man had driven the minivan\u00a0up to\u00a0the store drive-through and appeared to be highly\u00a0intoxicated. They also were advised that there was a small child in the back seat of the van.\u00a0 The troopers interviewed the driver,<\/p>\n<p>Troopers interviewed driver\u00a0James F. Moriarty, 35, of William Street, Rome, and observed that he had a strong odor of alcoholic beverage on his breath and an open container of an alcoholic beverage in the <!--more-->center console of the vehicle. Field sobriety tests indicated that Moriarty was intoxicated and he was taken into custody for DWI.<\/p>\n<p>A 3-yearold- child was observed to be secured in a child restraint in the backseat of the minivan. The child&#8217;s mother was notifed, and she responded to the scene to take the child. Moriarty was transported to the Oneida state police barracks, where a breath test determined\u00a0his blood-alcohol content to be .18 percent.<\/p>\n<p>A DMV check showed Moriarty&#8217;s license had been revoked for a previous DWI conviction within the past 10 years. He was\u00a0processed on the charges of felony DWI, felony aggravated DWI with a child in the vehicle, aggravated DWI with a BAC of .18 percent or greater, first-degree felony aggravated unlicensed operation, operating without an ignition interlock device, consumption of alcohol in a motor vehicle and endangering the welfare of a child.<\/p>\n<p>Moriarty was arraigned in Verona Town Court and remanded to the Oneida County Jail\u00a0in lieu of $10,000 cash or bond and is scheduled to reappear in Verona Court Nov. 1, 2016.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Oneida-based state police charged a Rome man with felony DWI under Leandra&#8217;s Law following an arrest in the town of Verona Friday evening.
