State Police announce the arrest of Richard M. Nellenbach, Jr., 27, from 7745 Ridge Rd., Lowville, and Malik X. Jones, 22, from 1230 Court St., Utica, for (3) counts of burglary 3rd degree, a class “D” felony.

Members from State Police in Marcy, Oneida and Herkimer were investigating burglaries that occurred June 1 through June 10, 2016 to a residence and numerous businesses throughout northern Oneida and Herkimer Counties.

On June 10, State Police executed a search warrant at a location in the City of Utica with the assistance from the Oneida County District Attorney’s Office, where various proceeds and contraband were recovered.

As a result of this investigation, Betheny A. Nellenbach, 27, from 1230 Court St., Utica, was charged with Endangering the Welfare of a Child, a class “A” misdemeanor.  Betheny was charged after her two children were removed from the address in Utica and turned over to family members.   A hotline referral was made with Oneida and Lewis County Child Protective Services being notified.

  • Richard M. Nellenbach, Jr., was arraigned in the Village of New York Mills before the Honorable Robert Glenn and remanded to the Oneida County Correctional Facility in lieu of $30,000 cash bail.
  • Malik X. Jones was also arraigned in the Village of New York Mills before the Honorable Robert Glenn and remanded to the Oneida County Correctional Facility in lieu of $25,000 cash bail.
  • Betheny A. Nellenbach was issued an appearance ticket returnable to Utica City Court at a later date.

Richard Nellenbach faces a total of 14 counts of burglary in Oneida County alone, while Jones faces a total of six counts.

This case has been forwarded to the Oneida County District Attorney’s Office for further action.  The Troop D Forensic Identification Unit also assisted in the investigation.
