Madison County Sheriff’s Deputies arrested Anthony J. Franklin, 39, of Jacksonville, Fla., charging him with Driving While Intoxicated (unclassified misdemeanor), Aggravated Driving While Intoxicated with a Child Passenger less than 16 years of age (E Felony), Aggravated Driving While Intoxicated – BAC of .18 or more (unclassified misdemeanor), Endangering the Welfare of a Child (class A misdemeanor) and Speeding (violation). Franklin was arrested Friday night, July 29th at approximately 10 PM.
While on routine patrol on Peterboro Road in the Town of Stockbridge, Madison County Sheriff’s Deputy Thomas Riolo observed by radar a vehicle driving 53 in a posted 35 MPH speed zone.
Riolo stopped the vehicle a short time later and, through further investigation, determined that Franklin was operating the vehicle while under the influence of alcohol. Franklin’s child, 5, was in the rear seat of the vehicle, along with three other relatives in the vehicle. Franklin’s BAC at the time of his arrest was .21%.
Franklin was arraigned at the Oneida City Court and remanded to the Madison County Jail in lieu of $2,000 cash bail. Franklin has since posted bail and is due back in court to answer charges at a later date.
