Utica pair arrested for possession of marijuana, cocaine after traffic stop

On Oct. 12, 2018, at approximately 9:02 p.m., state police stopped a vehicle in the village of Ardsley for multiple vehicle and traffic violations.
During the interview of the driver, Matthew M. Cuda, 58, of Utica, probable cause to search the vehicle and its occupants was established. Search of the vehicle and its passenger Dennis D. Rodgers, 36, of Utica, led to discovery of approximately 226 grams of cocaine, and approximately 1 gram of marijuana.
Both were taken into custody and transported to and processed at SP Hawthorne. They were subsequently charged with:
  • Second-degree criminal possession of a controlled substance; a class A felony (Cuda and Rodgers)
  • Third-degree criminal possession of a controlled substance; a class B felony (narcotic drug with intent to sell – Cuda and Rodgers)
  • Second-degree aggravated unlicensed operation; an unclassified misdemeanor (Cuda only)
  • Resisting arrest; a class A misdemeanor (Rodgers only)
  • Second-degree obstruction of governmental administration; a class A misdemeanor (Rodgers only)
  • Second-degree harassment; a violation (Rodgers only)
  • Unlawful possession of marijuana; a violation (Rodgers only)
  • Various vehicle and traffic violations (Cuda only)
Both men were arraigned in Ardsley Village Court and remanded to the Westchester County Jail without bail. They are scheduled to return to Ardsley Village Court Oct. 15, 2018, at 2 p.m.
