state-police-seal-150x150Oneida-based state police charged a Canastota man with DWI following a two-car accident in Lenox Saturday evening.

At approximately 6:35 p.m. Oct. 15, Trooper Joseph Leworthy was dispatched by Madison County 911 to a two-car crash on North Main Street Road.

His investigation determined that a 1998 Dodge Ram pickup truck operated by Kyle P. Phillips, 21, of Mill Street, Canastota, had pulled out of a driveway to drive south on North Main Street Road and failed to yield to an oncoming southbound 2001 Oldsmobile operated by Morgan L. Casler, 18, of North Main Street Road, Canastota.

The vehicles collided in the southbound lane of the roadway. While interviewing Phillips, Leworthy observed the odor of alcoholic beverage on the driver’s breath and sobriety tests indicated that Phillips was intoxicated. He was taken into custody for DWI and transported to the SP Oneida barracks, where a breath test revealed Phillips’ blood alcohol content was .13 percent.

A DMV check also showed Phillips’ driver’s license was in a suspended status. Phillips was ticketed for DWI, driving with a BAC of .08 percent or greater, third-degree aggravated unlicensed operation, failure to yield the right-of-way while entering the roadway and unlicensed operation. He is scheduled to appear in Lenox Town Court Oct. 25, 2016. Canastota Fire Department and Greater Lenox Ambulance personnel assisted at the scene.
