(Wampsville, NY – Aug. 12, 2013) Madison County Sheriff’s Deputies have issued charges to the driver of a motor vehicle involved in a serious two-car accident that occurred on Thursday, Aug, 8 in the Madison County Town of Eaton.
Deputies charged Cody M. Smith, 20, of Hamilton with one count of failure to stop at stop sign and failure to yield right-of-way. Both are violations of the NYS Vehicle and Traffic Law.
He is scheduled to appear in the Town of Eaton Court on Sept.18 to answer charges.

(Town of Eaton, Aug. 8, 2013) Madison County Sheriff’s Deputies are investigating a serious accident that occurred at approximately 12:10 p.m. this afternoon on State Route 26 in the Madison County Town of Eaton.
The two vehicle crash occurred State Route 26 and Cole Road.
A vehicle, operated by Cody M. Smith, 20, of Hamilton was traveling south on Cole Road and failed to stop at a stop sign where Cole Road and State Route 26 meet.
Smith’s vehicle was struck by a second vehicle, heading north on Route 26, operated by Sarah E. Rickey, 49, of Iowa City, Iowa.
Three passengers were in Smith’s vehicle; Christopher Marshall, 19, of Hamilton, Megan Viera, 18, of Sherburne, and Kamara Swayze, 19, of Sherburne. No passengers were in Rickey’s vehicle.
Rickey was transported to University Hospital in Syracuse by ambulance with head and back injuries as a result of the crash.
Smith was transported by ambulance to Community Memorial Hospital in Hamilton with non-life threatening injuries. Marshal was also transported to Community Memorial Hospital with non-life threatening injuries.
Swayze was transported to Saint Elizabeth’s Hospital in Utica by ambulance – her condition is unknown at this time. Viera was airlifted from the scene by Mercy Flight to Upstate Hospital in Syracuse in serious condition. Both Viera and Swayze were back seat passengers in Smith’s vehicle.
The investigation is continuing at this time. Charges are pending against Smith.
NYS Police, University Police from SUNY Morrisville, as well as Eaton Fire/Rescue, Madison Fire/Rescue, Morrisville Fire/Rescue, SOMAC, SEVAC, Madison and Eaton Ambulances, and Mercy Flight assisted on the scene. Sherburne Ambulance was placed on stand-by.
Further details on charges will be released upon completion of the investigation.
