Traffic stop leads to DWI charge in Verona

state-police-seal-150x150(Verona, NY – Jan. 4, 2016) Oneida-based state police charged a Clark Mills man with DWI following a traffic stop in Verona Saturday evening.

At approximately 9:35 p.m. on Jan. 2 Trooper Steven Fountain observed a 2003 Saturn Vue travelling south on State Route 365 in the town of Verona weaving back and forth from its driving lane.

Fountain activated the emergency lighting on his patrol vehicle, but the operator of the Saturn would not pull over.  The vehicle turned onto Willow Place and eventually stopped after pulling into the parking lot of a local hotel.

Upon being interviewed, the driver was identified as Patrick M. Nicholas, 38, of Clark Mills. Nicholas advised the trooper that he didn’t pull over immediately because he knew his driver’s license was revoked for a previous alcohol related conviction.  The trooper observed an open six pack of beer in the vehicle and that Nicholas had a strong odor of an alcoholic beverage on his breath.  Field sobriety tests determined that Nicholas was intoxicated and he was taken into custody for DWI.

Nicholas was transported to the SP Oneida barracks, where a breath test determined Nicholas had a blood alcohol content of .14 percent.  A DMV check confirmed that Nicholas’ license was expired and had been revoked since 2008.

Nicholas was charged with driving while intoxicated, Driving with a BAC of .08 percent or greater, felony first-degree Aggravated Unlicensed Operation, Unlicensed operator, open container in a motor vehicle and failure to keep right.

He was arraigned in the Town of Vernon Court and remanded to the Oneida County Jail in lieu of $500 cash or $1,000 bond.

Nicholas was scheduled to appear in the Town of Verona Court on Jan. 5.
